ERA 2011 SAF OP 03: benchmarking study of NSA (national safety authorities) enforcement powers. This study will provide an analysis of information on the current situation in relation to national requirements. It will include information gathered in the 25 Member States who operate rail systems, as well as in Norway and Switzerland. The study will map what already exists both in the railway sector and other selected industrial sectors, where similar enforcement approaches are in use and shall also examine what role does the NSA play in enforcing the safety regulatory framework and what tools does it have at its disposal to do this. The study will examine and compare the approaches to enforcement taken by the competent authorities in other selected industrial sectors to ensure compliance with the law and it will analyse the findings from the mapping phases, seek to establish what are successful approaches to enforcement both in railways and in other sectors, as well as the common features and the key differences between the enforcement regime in place in the railway sector and the enforcement regimes in other sectors. Security of information (SoI) in the context of the European defence equipment market (EDEM). In the communication 'A strategy for a stronger and more competitive European defence industry' of 2007, the Commission referred to a number of policies and measures to improve the functioning of the internal market for defence products. In this context, the communication stated that 'the Commission will investigate, in close cooperation with Member States, possibilities for an EU system on security of information that would allow exchange of sensitive information between Member States and European companies. This exercise will consider the potential scope, contents and form of such a system'. The objective of this possible EU initiative on security of information (SoI) is to be an instrument to strengthen mutual confidence among Member States, and to enhance the effectiveness of 2 directives: the Directive on defence procurement, and the Directive on intra-EU transfers of defence products. This tender represents the Commission's follow-up activity to the commitment set out in the above communication. The current situation concerning the protection of classified information in classified contracts and contract negotiations between EU Member States' authorities and European companies, and the absence of uniform rules on the management of classified information, on security clearances and on recognition of foreign security clearances, may have an impact on the good functioning of the European defence equipment market (EDEM). In this context, the purpose of this study is to provide a general overview of the current situation in EU Member States concerning the protection of classified information in contract negotiations and classified contracts, evaluate the impact of this situation on the EDEM and especially on the Defence Procurement Directive, and assess the need, added value and possibilities for EU action including the recommendation of possible options.
