National Safeguarder Panel. The Scottish Government is seeking to appoint a service provider to operate and manage a National Panel of Safeguarders to be known as "The Safeguarders Panel". This requirement has arisen due to a new law - The Children's Hearings (Scotland) Act 2011 (the 2011 Act) from which Section 32 has brought about significant changes to how safeguarders will be appointed and managed. The Children's Hearings (Scotland) Act 2011 (to be known as the 2011 Act) was passed by Parliament on 25.11.2010 and received Royal Assent on 6.1.2011. It is an Act of the Scottish Parliament to restate and amend the law relating to children's hearings and for connected purposes. One of the key outcomes from the Act is the establishment of a national panel of Safeguarders. Safeguarders are currently appointed by children's hearings or sheriffs when there is a requirement to safeguard a child's interest in the proceedings of a hearing. Safeguarders are self employed and are independent from all other agencies involved in the Children's Hearings system. The management, provision and payment of Safeguarders are currently the responsibility of each local authority that has statutory responsibility for the establishment and maintenance of a local safeguarder panel i.e. 32 panels in Scotland. There are around 200 Safeguarders in Scotland at present. Under the 2011 Act, it is now a requirement for Scottish Ministers to establish and maintain a panel of persons from which any safeguarder appointment is made. It is the intention of the Scottish Government to appoint a service provider who will deliver all operational and management requirements of The Safeguarders Panel to include: — promoting the Safeguarders Panel, — recruitment and selection of Panel members, — applying criteria on the appointment and removal of Panel members, — esuring attendance on Pre-appointment training and delivery of refresher training for Safeguarders, — monitoring performance; and, — making payments of fees and expenses to Safeguarders.
