Repair of articles classified as repairable as fitted to the LPPV (Foxhound) vehicle. Maintenance and repair services related to specific parts of vehicles. The Defence Support Group, Land Supply Business Unit (LSBU7), part of the UK Ministry of Defence, intends to place a contract with Force Protection Europe. The contract is for the repair of articles fitted to the LPPV (Foxhound) vehicle. It is considered that this contract can be placed using the negotiated procedure without prior publication pursuant to Article 28(4)(a)(i) of Directive 2009/81/EC (Regulation 16(1)(d)(i)(aa) of the Defence and Security Public Contracts Regulations 2011). This is because the Ministry of Defence needs to procure additional services under the above contract. Using another supplier would cause major technical and economic inconvenience to the Ministry of Defence. The Ministry of Defence intended to place separate contract(s) for subsequent repair support activity, taking into account the delegation of repair management responsibility to the Defence Support Group. However, the Ministry of Defence secured two separate warranties against the LPPV (Foxhound) vehicle, comprising a 12 month "Parts and Labour" warranty and a separate 36 month "Reliability" warranty. The reliability warranty is linked to the original parts and labour warranty, in that in the event of a series of failures to repairable articles, they are subsequently managed and covered under the reliability warranty. Having negotiated and paid for these warranties, the Authority considers it uneconomical to carry out this activity separate to the original production contract an in addition failure to manage equipment through the said warranties could invalidate the overall Warranty provisions.
