Study on the consequences of a deliberate attack on different types of liquefied gas tankers and oil and chemical tankers. For protecting the whole chain of maritime transport logistics, the European Union adopted 2 legislative acts: Regulation (EC) No 725/2004 of the European Parliament and of the Council of 31.3.2004 on enhancing ship and port facility security and Directive 2005/65/EC of the European Parliament and of the Council of 26.10.2005 on enhancing port security. Regulation (EC) No 725/2004 states in recital 2 that 'the security of European Community shipping and of citizens using it and of the environment in the face of threats of intentional unlawful acts such as acts of terrorism, acts of piracy or similar, should be ensured at all times.' Then, in its third recital, the Regulation specifically mentions that 'in connection with the transport of goods containing especially dangerous substances, such as chemical and radioactive substances, the potential consequences of the threats posed by the unlawful acts for the Union citizens and the environment are very serious'. The European Union is largely depending on energy imports. Alongside with oil tankers, gas tankers transporting LNG/LPG will become crucial for ensuring the energy supply and both the number of tankers and the number of LNG/LPG port facilities will substantially increase. Furthermore, the European Union is also a major trade partner regarding chemicals, refinery products, fertiliser and gasoline, a significant part of which is transported by ship. Carrying inflammable, explosive and/or toxic products these tankers may be a primary target for terrorist attacks. Typical scenarios include a suicide attack via speedboat such as in the case of the tanker 'Limburg', firing at or missile attacks from the shore or hijacking with the purpose to use the ship to damage port infrastructure and/or adjacent neighbourhoods. Contrary to other types of ship, the consequences of terrorist attacks are not limited to the ship itself; one of the greatest concerns is the potential for the deliberate release of toxic gases and the ignition of massive vapour clouds. There is no doubt regarding the seriousness of these consequences, but in the lack of facts the threat perceived by the public may go beyond the real one with the appropriate consequence on acceptance of oil, chemical, fertiliser, refinery products and gas transport and appropriate facilities. The purpose of this contract is to analyse the vulnerability of LNG, oil and chemical tankers with respect to terrorist attacks, evaluate its consequences and making proposals for appropriate measures of protection. Study on the legal framework covering business-to-business unfair trading practices in the retail supply chain. The study will provide a comprehensive overview and analysis of national legislations, codes of conduct, guidelines, other self-regulatory instruments, enforcement mechanisms and existing case-law that cover principles related to fairness and rules on unfair trading practices in business-to-business relationships along the retail supply chain in the 27 Member States and Croatia. It will provide a comparative assessment of these existing instruments and mechanisms and cluster these 28 countries according to the approach taken, as well as assess the impact of these existing approaches on the internal market. Finally, the study will classify the different regulatory and non-regulatory approaches used in the 27 Member States and Croatia including the enforcement mechanisms in terms of their effectiveness and suitability to address the problem of unfair trading practices and propose options on how to possibly address the problem of the fragmentation of the internal market resulting from diverging rules on business-to-business unfair trading practices in the retail supply chain. The study should achieve the following: — a comprehensive and accurate overview of the national legislations, codes of conduct, guidelines, other self-regulatory instruments (limited to the retail supply chain) and enforcement mechanisms, as well as existing national case-law that cover principles related to fairness and rules on unfair trading practices in business-to-business relationships per country, covering the 27 Member States and Croatia, — a comparative assessment of the national legislations, codes of conduct, guidelines and other self-regulatory instruments and enforcement mechanisms, as well as existing national case-law, — a comparison and clustering of the 27 Member States and Croatia according to criteria agreed by the Commission services, — a classification of the different national regulatory and non-regulatory approaches including the enforcement mechanisms to address the problem of unfair trading practices.
