Hertfordshire County Council (the Authority) is seeking an innovative private sector partner for the provision of a Managed Service for Temporary Staff Recruitment (the 'HCC Service Contract') and a separate Framework Agreement for the Participating Bodies (the 'Participating Bodies Service Framework' (PBSF)) collectively known as the 'Temporary Staff Recruitment Contracts'. The Authority has a long history of outsourcing recruitment services and it is anticipated that the Temporary Staff Recruitment Contracts could be provided through a Master Vendor or other hybrid solutions, it is unlikely that a 'Neutral Vendor' model will suit the needs of the authority for the delivery of this service. The Authority is also interested in exploring new approaches to sourcing temporary agency staff. The Authority is keen to ensure future proofing and innovation so that it keeps pace with the changing recruitment market. The types of temporary agency workers to be included are wide ranging from grounds maintenance, administrative and residential care staff through to professional staff such as legal, financial and procurement. An out of hour's service will be required. The Authority is currently reviewing its processes in relation to permanent recruitment following expiry of the current contract in April 2013. As a result of this review, the Authority may at sometime during the term of the HCC Service Contract add permanent recruitment (and any associated processes) to the HCC Service Contract. This will be at the sole discretion of the Authority. The CPV code is 79620000. The anticipated value range is 1 000 000 - 2 000 000 GBP pa. The principal outputs of the HCC Service Contract will be to; achieve efficiencies and deliver effective services, provide value for money and deliver continuous improvement and innovation in respect of the sourcing of temporary agency workers. It is anticipated that the service provider will need to deliver the service from April 2013. Further details are contained within the Initial Descriptive Document and the Pre Qualification Questionnaire. The contract period will be for an initial four (4) years with the option to extend for up to a further two (2) years at the sole discretion of the Authority. Please note that the estimated value range for the contract is based on the initial 4 year period. Should the discretionary 2 year extension be taken up the estimated value range will be £20m - £150m. In addition to the HCC Service Contract there will be a separate Framework Agreement (PBSF) for call-offs by any organisations listed on the Supply Hertfordshire website (http://supplyhertfordshire.g2b.info/hpf/members.shtml), Hertfordshire Schools and Academies and Hertfordshire Police Authority (including Hertfordshire Constabulary) and any other authorities within the Eastern Region – http://www.direct.gov.uk/en/Dl1/Directories/Localcouncils/DG_4003594 (the 'Participating Bodies') Services to Schools and Academies in Hertfordshire are included in the procurement of the PBSF and the service provider will be expected to offer their services to Schools and Academies (for non-teaching staff only). However, there is no guarantee that Schools or Academies will call off the contract as currently they have separate arrangements in place and mostly source temporary agency staff themselves. The Participating Bodies Services Framework (PBSF) agreement will last for 4 years and will be negotiated alongside the HCC Services Contract. The form of call off contract will also be negotiated during the procurement process, although the Participating Bodies will have the right to agree specific amendments to a particular call off. The expiry of any individual call-off contract under the PBSF will not extend beyond the total period of the HCC Service Contract, which is 4 years (with option to extend for a further period of up to 2 years at the Authority's sole discretion). For the avoidance of doubt this means that services provided to Partners must end when the Council's contract terminates on 31st March 2017. Should the HCC service contract be extended Partners will be able to continue to call off the contract until the expiry of the contract extension. Accordingly it is the intention that the Participating Bodies should be able to rely on this procurement to purchase such services without the need for any further procurement process. It should also be noted that in the event of re-structuring within local government that this procurement and/or the Temporary Staff Recruitment Contracts awarded will pass to successor authorities to the Authority and the Participating Bodies as appropriate. No guarantee or warranty is given as to the nature or volume, if any, or the number of call-offs, if any under any Framework Agreement. The Authority reserves the right not to award the HCC Service Contract or PBSF or to award only the HCC Service Contract and not to award the PBSF. The Temporary Staff Recruitment Contracts will be procured using the Competitive Dialogue procedure in accordance with Regulation 18 of the 2006 Regulations. As this service falls within "Part B" of the directives and therefore is not fully regulated it gives the Council flexibility around process design hence a simplified dialogue process will be employed which will reduce the resource required. The reason for this is that those services which are deemed to fall within Part B are only partially subject to EU procurement rules – namely, obligations relating to technical specifications and post-award information.
